Estos términos regulan el acceso y uso de la plataforma de gestión para negocios Zigsa, incluidas listas de espera, reservas, gestión de clientes, comunicaciones y servicios relacionados (el "Servicio"). El proveedor es ZIGSA AGENCY, C.A. · RIF J-50356578-0 · Urb. Los Olivos, Calle 75 #61-141, Maracaibo, Estado Zulia 4001, Venezuela · [email protected] ("nosotros"). Al crear una cuenta o usar el Servicio aceptas estos términos.

1. El Servicio

Zigsa ofrece herramientas para gestionar listas de espera, citas, clientes, personal, comunicaciones, pagos y operaciones relacionadas. Las funciones pueden variar según el plan y los complementos activos, y cambiar con la evolución del Servicio.

2. Cuentas

Debes proporcionar información correcta y proteger tus credenciales.
Eres responsable de la actividad de tu cuenta, incluida la del personal que invites.
Debes tener capacidad legal para contratar.

3. Tus datos y los de tus clientes

Conservas la titularidad de los datos que tú y tus clientes introduzcan.
Eres responsable de cumplir las leyes aplicables a tu negocio y obtener los consentimientos necesarios para guardar información de clientes; en sectores regulados como salud, también las normas profesionales y de datos aplicables.
Nos concedes un derecho limitado a tratar esos datos solo para prestar el Servicio.

4. Suscripciones y pagos

Los planes de pago y complementos se cobran periódicamente mediante Stripe hasta su cancelación.
Las pruebas, cuando se ofrecen, pasan a suscripciones de pago si no se cancelan antes de finalizar.
Los importes no son reembolsables salvo cuando lo exija la ley.

5. Uso aceptable

No debes usar el Servicio para spam o comunicaciones ilícitas, infringir derechos, cargar código malicioso, intentar acceder sin autorización al Servicio o sus datos, ni revenderlo sin permiso. Podemos suspender o cerrar cuentas que incumplan estos términos.

6. Servicios de terceros

El Servicio se integra con terceros como Google Calendar, Stripe y proveedores de mensajería y video. Su uso está sujeto a sus propios términos y no somos responsables de ellos. Conectar una cuenta externa es opcional y puedes desconectarla en cualquier momento.

6a. Redes sociales

Cada negocio conecta únicamente sus propias cuentas o aquellas que está autorizado a administrar, y es responsable del contenido y de las automatizaciones que configura y aprueba. Las funciones y permisos disponibles dependen de cada plataforma. Al usar estas funciones debes cumplir también los términos aplicables de Meta, Instagram, TikTok y YouTube. Al usar las funciones de YouTube aceptas quedar sujeto a los Términos del Servicio de YouTube.

7. Disponibilidad y cambios

Trabajamos para mantener el Servicio disponible y seguro, pero se ofrece "tal cual" y "según disponibilidad", sin garantías de ningún tipo. Podemos modificar o retirar funciones con aviso razonable cuando sea posible.

8. Limitación de responsabilidad

En la medida permitida por la ley, Zigsa no responde por daños indirectos, incidentales, especiales o consecuentes, ni por pérdidas de beneficios, ingresos o datos derivadas del uso del Servicio. Nuestra responsabilidad total no superará los importes que nos hayas pagado en los doce meses anteriores a la reclamación.

9. Terminación

Puedes cancelar tu cuenta en cualquier momento. Podemos suspender o terminar el Servicio por incumplimiento. Al terminar puedes solicitar una exportación de tus datos dentro de un plazo razonable.

10. Cambios en estos términos

Podemos actualizar estos términos. Continuar usando el Servicio tras la entrada en vigor de los cambios implica aceptarlos.

These Terms of Service ("Terms") govern your access to and use of the Zigsa business management platform, including waitlist, booking, customer management, communications and related services (the "Service"), operated by ZIGSA AGENCY, C.A. · RIF J-50356578-0 · Urb. Los Olivos, Calle 75 #61-141, Maracaibo, Estado Zulia 4001, Venezuela · [email protected] ("we", "our", or "us"). By creating an account or using the Service you agree to these Terms.

1. The Service

Zigsa provides software tools for businesses to manage waitlists, appointments, customers, staff, communications, payments and related operations. Features may vary by plan and enabled add-ons, and may change as the Service evolves.

2. Accounts

You must provide accurate information when creating an account and keep your credentials secure.
You are responsible for all activity under your account, including activity by staff members you invite.
You must be legally capable of entering into a contract to use the Service.

3. Your Data and Your Customers' Data

You retain ownership of the data you and your customers enter into the Service.
You are responsible for complying with the laws that apply to your business, including obtaining any consents required to store your customers' information (and, for regulated verticals such as healthcare, complying with the applicable professional and data regulations).
You grant us the limited right to process that data solely to provide the Service.

4. Subscriptions and Payment

Paid plans and add-ons are billed through Stripe on a recurring basis until cancelled.
Trials, when offered, convert to paid subscriptions unless cancelled before the trial ends.
Fees are non-refundable except where required by law.

5. Acceptable Use

You agree not to use the Service to send spam or unlawful communications, infringe the rights of others, upload malicious code, attempt to gain unauthorized access to the Service or its data, or resell the Service without our authorization. We may suspend or terminate accounts that violate these Terms.

6. Third-Party Services

The Service integrates with third-party services (for example Google Calendar, Stripe, messaging and video providers). Your use of those services is governed by their own terms, and we are not responsible for them. Connecting a third-party account is optional and can be disconnected at any time.

6a. Social media

Each business connects only its own accounts or accounts it is authorized to manage, and is responsible for the content and automations it configures and approves. Available features and permissions depend on each platform. Users of these features must also follow the applicable terms of Meta, Instagram, TikTok and YouTube. By using the YouTube features, you agree to be bound by the YouTube Terms of Service.

7. Availability and Changes

We work to keep the Service available and secure, but it is provided "as is" and "as available", without warranties of any kind. We may modify or discontinue features with reasonable notice where practical.

8. Limitation of Liability

To the maximum extent permitted by law, Zigsa shall not be liable for indirect, incidental, special or consequential damages, or for loss of profits, revenue or data, arising from the use of the Service. Our total liability for any claim shall not exceed the amounts you paid to us in the twelve months preceding the claim.

9. Termination

You may cancel your account at any time. We may suspend or terminate the Service for breach of these Terms. Upon termination you may request an export of your data within a reasonable period.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
